J&D provides this software and/or data in electronic format on diskette/CDROM medium and licenses its use on a single personal computer to be used by one person at a time. Neither software or data provided by J&D may be used on a network, bulletin board or placed in a multiuser environment. You, as the purchaser of this data, assume responsibility for the selection and use of this software to achieve your intended results.
All programs and/or data are protected by copyrights of J&D and by other parties. Data protected under copyright by other parties other than J&D is being used by permission. The copyright holder(s) reserve all rights and remedies under the copyright laws of the United States.
You may (1) personally use the software and/or data; (2) download to disk or reproduce in printed form limited portions of the software and/or data for incidental use only; and (3) copy or save the software for backup purposes.
You may not (1) use, copy, or transfer the software or data, or any copy, modification, or combined portion, in whole or in part, except as expressly provided in this agreement. Reproduction of the software and/or data, in whole or in part, for sale, is a violation of copyright laws, and offenders will be prosecuted.
This license is effective until terminated. You may terminate the license at any time by returning to J&D or destroying all software and data provided to you by J&D, all copies of the software and/or data in any form.
J&D will replace or refund, at J&D's option, defective products which are returned within one year of purchase. However, J&D does not warrant that the functions contained in the software and/or data will meet your requirements or that the operation of the software and/or data will be error free. No other warranty of any kind, either expressed or implied is applicable.
In no event will J&D be liable to you for any damages, including any lost profits, lost savings or other incidental or consequential damages arising out of the use or inability to use such software and/or data.
This agreement will be governed by the laws of the State of Utah.
By retaining the software and/or data you acknowledge that you have read this agreement, understand it, and agree to be bound by its terms and conditions. You further agree that it is a complete and exclusive agreement between you and J&D.
This Data may be only used for commercial purposes with permission from J&D Distributing. A license fee will be charged that will be based upon the number of recipes utilized and the number of copies of the final product produced. By utilizing recipes from this collection within a commercial product, the producer of such product agrees to pay to J&D Distributing a fee $.01 per recipe per copy of product distributed, unless prior arrangements are made in writting with J&D Distributing.
